Who we are

This website, www.buildingsurvey.ie, is operated by BM Design & Surveying, Funshog, Collon, Co. Louth (“we”, “us”). We are the data controller for the personal data described in this policy. For any privacy question or request, email info@buildingsurvey.ie.

What we collect

  • Enquiries — your name, email address, phone number, the property address and the details you send us through the contact form, by email, phone or WhatsApp.
  • Client work — information needed to carry out the job, such as property details, photographs, measurements and survey data, folio and planning information, and details of your solicitor or lender where you ask us to deal with them.
  • Billing — the details needed to issue invoices and keep accounts.
  • Website use — only if you accept analytics cookies, Google Analytics collects information about how the site is used (pages visited, device and approximate location). See “Cookies” below.

We do not ask for special category data (for example health information), and the website does not have user accounts.

Why we use it, and our lawful basis

  • To reply to your enquiry and give you a quote — steps taken at your request before entering a contract (GDPR Article 6(1)(b)).
  • To carry out the survey, report, design, mapping, certification or BER you have asked for — performance of a contract (Article 6(1)(b)).
  • To keep accounts, lodge BERs with SEAI and meet other legal and regulatory duties — legal obligation (Article 6(1)(c)).
  • To keep records of our work in case of a later query or claim, and to keep our systems secure — our legitimate interests (Article 6(1)(f)).
  • To measure how the website is used — your consent (Article 6(1)(a)), which you can withdraw at any time.

We do not sell your data and do not use it for marketing without your consent.

Who we share it with

Only where needed: the Sustainable Energy Authority of Ireland (SEAI) when a BER is published; your solicitor, lender or the local authority where the job requires it or you ask us to; our professional indemnity insurer and professional body if a matter arises; our accountant and the Revenue Commissioners; and service providers who host or support this website, our email and our records (including Register365 / Duda for the website, iubenda for cookie consent and, with your consent, Google for analytics). These providers act on our instructions and are bound to protect your data.

Transfers outside the EEA

Some service providers, such as Google, may process data outside the European Economic Area. Where this happens, the transfer is protected by an adequacy decision (such as the EU–US Data Privacy Framework) or the European Commission’s Standard Contractual Clauses.

How long we keep it

  • Enquiries that do not go ahead: up to 12 months, then deleted.
  • Client files, reports and drawings: for as long as a query or claim could reasonably arise about the work, normally at least six years after the job is completed, and longer where certification or our insurers require it.
  • Accounting records: six years, as required by Revenue.
  • Analytics data: for the retention period set in our Google Analytics account, no longer than 14 months.

Your rights

You have the right to access the personal data we hold about you, to have it corrected, to have it erased, to restrict or object to its use, to data portability, and to withdraw consent at any time. To make a request, email info@buildingsurvey.ie; we will reply within one month. Some data may need to be kept where the law requires it.

If you are unhappy with how we handle your data, you can complain to the Data Protection Commission, 21 Fitzwilliam Square South, Dublin 2, D02 RD28, www.dataprotection.ie.

Cookies

Strictly necessary cookies keep the website working and do not need consent. Analytics cookies (Google Analytics) are only set if you click “Accept” in the cookie banner. You can change or withdraw your choice at any time using the cookie preferences button on every page. Details of each cookie are in the cookie policy linked from the banner.

Security

We use reasonable technical and organisational measures to protect your data, including secure (HTTPS) connections, password-protected devices and access limited to those who need it.

Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed.
